Dr. Mulgrew promotes the revision of penal policy on foreign nationals on probation at the 39th PC-CP Meeting, Kraków
On 23rd October 2025, Dr. Mulgrew, along with Daniel Danglades (France) and Michael Sorger (Austria) presented their recommendations for the inclusion of a new section on Probation in the revised recommendation on foreign nationals in prison and probation to the 39th Working Group Meeting of the PC-CP in Kraków, Poland.
This new section represents a significant advancement in addressing the needs of foreign nationals, being the only part of the revised Recommendation dedicated specifically to this group under probation. It aligns with the European Rules on Probation, ensuring coherence with established Council of Europe standards.
The foundation of this initiative was established during a productive expert roundtable hosted at University of Galway on 26 June 2025, with senior officials, practitioners, NGO representatives, and leading academics.
Following the discussions at University of Galway, a draft proposal was developed and shared for targeted review, fostering an inclusive process. Extensive consultations with academics across Europe were conducted to enhance the provisions, ensuring legal clarity, operational feasibility, and alignment with international standards. The result is a thoughtful set of practical, rights-based measures that effectively address the long-standing gap in guidance on non-custodial interventions for foreign nationals, paving the way for more equitable and informed practices.
